Terms and Conditions – Luxury Exclusive Resorts
GENERAL TERMS AND CONDITIONS – Luxury exclusive Resorts.
Definitions
In these general terms and conditions the following terms shall have the following meanings:
– Luxury Exclusive Resorts, located at Mej. N. Schipperstraat 37, 3262GJ Oud-beijerland, registered with the Chamber of Commerce under number 80990444, VAT number NL003513827B55.
– Client: the natural person or legal entity that shows interest in purchasing real estate through Luxury Exclusive Resorts.
– Developer: the party that develops the real estate and concludes the final purchase agreement with the client.
– Agreement: the intermediary relationship between Luxury Exclusive Resorts and the client during the process up to the conclusion of a purchase agreement.
– Project: the real estate project offered through Luxury Exclusive Resorts.
2. Applicability
2.1. These terms and conditions apply to all offers, services, and activities of Luxury Exclusive Resorts, unless otherwise agreed in writing.
2.2. By using the services of Luxury Exclusive Resorts, the customer agrees to these terms and conditions.
3. Services
3.1. Luxury Exclusive Resorts acts as an independent intermediary and broker between real estate developers and interested buyers.
3.2. Luxury Exclusive Resorts provides guidance throughout the purchasing process, shares market information, and, if desired, refers to third parties for legal support.
3.3. Luxury Exclusive Resorts is not a party to the final purchase agreement. This is concluded between the client and the developer.
4. Reimbursement and payments
4.1. Luxury Exclusive Resorts generally receives its compensation in the form of commission from the developer. In some cases, such as for homes already completed by private investors, Luxury Exclusive Resorts may charge a separate fee.
4.2. Luxury Exclusive Resorts is not authorized to increase the sales prices set by developers.
4.3. Payments are made directly between the client and the developer or through an agreed-upon third party. Only reservation fees can be processed through Luxury Exclusive Resorts. These are immediately transferred to the relevant developer.
5. Liability
5.1. Luxury Exclusive Resorts excludes all liability for:
– Delays in delivery of projects;
– Deviations in the end result compared to visuals, artist impressions or renders;
– Changes in design, choice of materials or facilities;
– Non-compliance with or inaccuracy of promised returns, rental income or increases in value;
– Construction defects, legal disputes or changes in local laws and regulations.
5.2. Luxury Exclusive Resorts is only liable for damage resulting from demonstrable and written agreed obligations that have not been fulfilled by Luxury Exclusive Resorts.
5.3. Luxury Exclusive Resorts does not have professional liability insurance.
6. Duration and termination of the mediation
6.1. The relationship between the client and Luxury Exclusive Resorts is non-binding and is primarily informative and supportive.
6.2. The relationship generally ends as soon as the client enters into a purchase agreement with a developer.
6.3. Both the client and Luxury Exclusive Resorts may terminate the partnership at any time, without giving a reason.
7. Complaints and disputes
7.1. Complaints can be submitted in writing to info@luxuryexclusiveresorts.nl. Luxury Exclusive Resorts strives to handle them adequately and promptly.
7.2. These terms and conditions are exclusively governed by Dutch law.
7.3. Disputes between the customer and Luxury Exclusive Resorts will be submitted exclusively to the competent court in the district of Rotterdam.
8. Privacy and disclaimer

9. Other provisions
9.1. If any provision of these terms and conditions proves to be null and void or is annulled, the remaining provisions will remain in full force and effect.
9.2. These terms and conditions may only be waived in writing.
