Luxury Exclusive Resorts  is responsible for processing your personal data and, in legal terms, consists of:

• Luxury Exclusive Resorts, with head office at Miss N. Schipperstraat 37, 3262 GJ Oud-Beijerland.

Our IT department is located in the Netherlands.

3. What data does Luxury Exclusive Resorts process?

 Luxury Exclusive Resorts  processes the following types of personal data when you share it directly with us or when you use our services:

• Identification, contact, and payment information : Luxury Exclusive Resorts processes the identification and contact information you provide when you register for an account, an event, a promotion, or when you subscribe. The data we process in this context includes, for example, your name, address, email address, telephone number, date of birth, gender, and, if applicable, billing and payment information. The registration process indicates whether the requested information is mandatory or not. If the requested information is mandatory, you will not be able to complete the registration process if you do not provide the requested information, as otherwise we will not be able to provide the services to you (under optimal conditions).
• Usage data : When you’re logged in, we collect data about your use of our services, such as which television programs you enjoy watching, which news articles you find interesting, which events you attend, or which magazines and news media you’re interested in. When this data is stored and retrieved on your device, we always take your cookie settings into account. More information about this can be found in our  cookie policy .

For example, if you often read sports articles, you may be placed in a “Sportslovers” user group. This information is used to make some of our services as relevant and personalized as possible for you. • Communication preferences : We also collect information about your preferences regarding our communications with you (via email, push notifications, post, or phone). You communicate these preferences directly to us during registration or through your account settings, or indirectly through the Do Not Call Me List and the Robinson List (see section 8 below).

4. What is my data used for?

• in the context of the preparation, performance or termination of our contract with you (e.g. providing you with information, supplying our products and services, invoicing, etc.);

• for the purposes of our legitimate interests, in which case we always strive for a balance between that interest and respecting your privacy (e.g. in the case of marketing and advertising for our services).

If processing your personal data is not necessary for one of the three reasons mentioned above, we will always ask your permission to process your personal data.

Specifically, we collect personal data for the following specific purposes:

• To process your request for our services : If you are not yet a customer and you visit our website to gather and/or request information about our products and services, we will need your contact information. We will use all information we receive about you during this (pre-contractual) phase solely to provide you with the requested information. If you ultimately decide to become a customer of one of our brands or use our services, you will need to provide us with some personal data to create an account (see above) to manage our contractual relationship. If you entered your information on our website but did not complete the purchase process, we will send you a one-time reminder via email.
• To fulfill our contract with you and provide our services : We use data to provide our services and for all related administration. Contact information provided may be used to inform you about changes to the services or to provide you with more information about the services. This data is also used for billing and payment purposes.
• To improve our services and identify general trends : We may use general usage information to identify areas for improvement in our services. This is done, for example, based on your feedback about our services, data we obtain during our interactions with you (e.g., in writing or by phone), questions you send us, or recordings of our customer service calls. You may also be asked to voluntarily participate in certain surveys so that we can evaluate and improve our services and/or research and develop new products or services.
• To offer you personalized content : If you choose this in your cookie settings, we can also make the content of our services as relevant as possible for you based on your use of our services and your personal data.
• To send you direct marketing about our services via email, SMS, and push notifications : Luxury Exclusive Resorts may also use your contact information to communicate with you about news, future promotions that we think may be of interest to you, or to offer you new products and services from Luxury Exclusive Resorts. We may also use the data we have to send you personalized marketing tailored to your interests. Luxury Exclusive Resorts always takes your personal preferences into account. On your profile page, you can indicate your personal preferences and specify which types of communications you would like to receive.
• To show you targeted ads on Google and Facebook : Luxury Exclusive Resorts may share your pseudonymized email address with online marketing companies like Google and Facebook. If you are known to these companies and your ad settings on their platforms allow this, Luxury Exclusive Resorts can show you appropriate ads through their channels.
• To show you targeted ads on our own websites and apps : When you opt for targeted ads in your cookie settings, we may also use information you provide when creating your account to make ads on our sites and apps even more relevant to you. Your first and last name are never used for this: only your place of residence, gender, hashed email address, and age are linked to your click behavior. Advertisers who have your email address may share it in hashed form with Luxury Exclusive Resorts to reach you with their ads on our sites and apps. • To prevent and/or detect abuse or fraud : Luxury Exclusive Resorts may also use your data to prevent, detect and investigate illegal or suspected illegal practices, such as fraud (for example with payment methods), as well as to enforce our Terms of Use.
• To comply with laws and regulations : We may also use your personal data to comply with laws and regulations that Luxury Exclusive Resorts is subject to and to conduct audits and reviews. Luxury Exclusive Resorts may be legally obligated to disclose personal information in the context of a dispute or legal proceedings, or if certain government agencies (e.g., police, courts, emergency services) require this. To comply with these laws and regulations, we may disclose this information without your knowledge, without your consent, or even without notifying you. Furthermore, we are legally obligated to retain certain data for our general tax and accounting obligations.
• To track studies, tests, and statistics : We may use your anonymous, aggregated data to, for example, report internally and externally on the use of our services. The data used for this purpose cannot be traced back to a specific individual. We use the information we obtain from these analyses to evaluate our current Services and processes and to adjust them based on new developments.

5. Does Luxury Exclusive Resorts engage in automated individual decision-making?

No. European data protection law (GDPR) imposes certain conditions on organizations when they make decisions about individuals solely based on automated processing, including profiling, and when these decisions have legal effects or other significant consequences. Specifically, the law refers to examples such as the automatic rejection of an online credit application or the processing of online job applications without human intervention. Luxury Exclusive Resorts does not engage in this type of decision-making.

6. To whom can my personal data be passed on?

We never sell your personal data to other companies, and we don’t allow third parties to use your data for their own purposes unless you give permission. Specifically, your data is only shared with the following parties:

• Suppliers, subcontractors and other service providers : We use other companies, agents, subcontractors or other service providers to perform certain services on our behalf or to assist us in providing services to you. For example, we use suppliers to provide marketing, communications, infrastructure and IT services, to optimize our services, to process credit card transactions and reduce fraud on credit card transactions or other payment methods, to provide customer service, to collect debts, to analyze data, and to process and manage user feedback. In the course of providing these services, these suppliers may have access to your personal data or other information.
  In any case, we only authorize these companies to process your personal data to the extent necessary for the provision of their services or to comply with certain laws, and we require them to take appropriate measures to respect the confidentiality of your personal data with appropriate security.
• Commercial partners : When you participate in a contest or promotion, your data may be shared with the commercial partner with whom the promotion was organized. The partner in question is always clearly stated in a disclaimer on the entry form. We never sell your personal data to third parties.
• Governments : We may also share or disclose personal data, including the content of your communications: (i) to comply with the law or respond to legal process or legal requests; (ii) to detect, prevent, or otherwise address fraud and technical security issues; or (iii) to protect the rights and property of Luxury Exclusive Resorts, including enforcement of our Terms of Use.
• Social media platforms : Our websites and apps allow you to register and log in using your Facebook or Google account, and to share articles and content on social media platforms. When you use these options, you share certain data with these platforms. The processing of this data is, of course, subject to the privacy policies of the respective platforms. In addition, your contact information may be shared with these companies to show you customized advertisements for our services on their platforms.
• Business Transfers : Luxury Exclusive Resorts reserves the right to transfer information, including personal information, in connection with any reorganization, restructuring, merger, sale or other transfer of assets, provided that the receiving party agrees to process your personal information in accordance with our Privacy Policy.

When these parties process data outside the European Economic Area (EEA), we ensure that your data remains protected there as required by European law. We do this by including standard clauses in our contracts with these companies, unless the processing takes place in a country recognized by the European Commission as  providing adequate data protection  .

7. How long will my personal data be retained?

We do not retain your data for longer than necessary for the purpose for which it was collected, taking into account that some data must be retained for a certain period of time to comply with certain legislation.

In concrete terms, this means that we retain all the data types listed above as long as you are a customer or have an account with us. If you no longer have an active customer relationship with us or no longer use your account, we retain your personal data in our systems for another two years, in case you become active again or become a customer again. We also use your data for direct marketing during this period, for example, to send you an offer to renew your subscription, unless you have previously indicated that you do not wish to receive direct marketing.

After the two-year period, your account will be closed and all associated data will be deleted. Only if you had a paying customer relationship with us will we archive your identification, contact, and payment information. In that case, this information will be retained for 10 years after your last payment for the purpose of instituting, exercising, or defending any legal claims.

8. What are my rights and how do I exercise them?

The right to data protection is a fundamental right in the European Union. Even when you share data with companies, you must always be able to maintain control over your personal data. Below, we list your rights and how you can exercise them at Luxury Exclusive Resorts:

Right of access
You have the right to receive confirmation from Luxury Exclusive Resorts as to whether or not we are processing your personal data, to obtain access to the personal data and how and why they are processed, as well as a copy of the data concerned.

Right to rectification:
You have the right to request correction of your data if you notice we are processing incorrect data about you. If this concerns your identification, contact, or payment information, you can edit this information yourself in your account or profile.

Right to erasure
You have the right to request the erasure of your personal data. This is not an absolute right and therefore does not always apply. You can exercise this right  via this link .

Right to restriction:
You have the right to restrict the processing of your personal data in certain specific cases. You can exercise this right by sending an email to info@luxuryexclusiveresorts.nl with the subject line “Privacy.”

Right to data portability:
You have the right to request the data you provided to us in connection with processing based on your (explicit) consent or that is strictly necessary for the performance of an agreement with you. Right to object:
You have the right to object, on grounds relating to your particular situation, to the processing of your personal data based on our legitimate interest, including profiling. You can exercise this right by sending an email to info@luxuryexclusiveresorts.nl.

Right to object to direct marketing
You also have the right to object to direct marketing. This right is absolute – it must always be followed. In certain cases, you can already exercise this right when you share your data with us. In addition, you can always unsubscribe from electronic direct marketing communications through your account settings and via the unsubscribe link in received messages. Right to withdraw consent:
If you have given consent for certain processing of your data, you can withdraw it at any time. Withdrawing consent is always as easy as giving consent: if you opted in to a newsletter, you can always unsubscribe through your account settings or via the unsubscribe link in every email you receive. 9. Changes to this Privacy Policy

We will occasionally update this Privacy Policy, for example, to reflect changes to our services. When we publish changes to the Privacy Policy, we will change the “last updated” date at the top of the document and let you know exactly what has been changed. If there are significant changes to the Privacy Policy or how we use your personal data, we will notify you by posting a notice about the changes before they take effect.
